foof was developed by the foofers – Bill, Jeremy, Dean, Barry, and Miguel - from Wladimir Palant’s open source code. This was done with the strong support of our colleagues and the management of TextWise. Karma, our mascot, gave us all encouragement as we worked our way through Xul.

Introduction:

Welcome to foof, a service of TextWise, LLC. By accessing the foof website ("Site") or using the foof Firefox add-on (“add-on”) or using the services offered by foof ("Services") you agree and acknowledge to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms or to our Privacy Policy, please do not access the Site or use the Services. TextWise reserves the right to change these Terms at any time. We recommend that you periodically check this Site for changes.


1. Usage License
TextWise grants you a limited license to access the Site, the add-on, and use the Services in accordance with these Terms and the instructions and guidelines posted on the Site. TextWise reserves the rights to terminate your license to use the Site and Services at any time and for any reason or in the future charge for commercial usage.

You are solely responsible for your use of the Site, the foof add-on and the Services. Because foof merely serves as a repository of information, user-posted content does not represent the advice, views, opinions or beliefs of foof or TextWise, and TextWise makes no claim of accuracy of any user-posted material. The linked websites' content, business practices and privacy policies are not under our control, and we are not responsible for the content of any linked website or any link contained in a linked website. The inclusion of a link on the Site, add-on, or Services does not imply any endorsement by or any affiliation with foof or TextWise. In accessing the Site and Services or following links to third-party websites you may be exposed to content that you consider offensive or inappropriate. 3. User-Posted Content
By posting content in the forum, you are granting permission to us and others to access and use it in connection with the Services, the Site and otherwise in connection with our business. For publicly accessible content, you can label your compilations with one of several possible licenses. Except as set out in these Terms, no reproduction of any foof-originated content is permitted without written permission from TextWise. User-posted content is copyrighted, and any use or reproduction of user-posted content must comply with the terms of the respective license(s) and must include a label indicating such license.


5. No Warranty and Limitation of Liability
TEXTWISE PROVIDES THE SITE, ADD-ON, AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. These Terms supersede any previous agreement and represent the entire agreement between TextWise and you. These Terms are governed by the laws of the State of New York without reference to conflict of laws principles. If any provision of the Terms is adjudged to be illegal or unenforceable, the continuation in full force of the remainder of the Terms will not be prejudiced, and the illegal or unenforceable provision of the Terms shall be severed accordingly. Your foof forum account information is protected by a password for your privacy and security. Protect against unauthorized access to your password and to your computer by logging off once you have finished using a shared computer.

By visiting your Account Settings, you can correct, or amend, personal information on our website. You may request deletion of your foof account by e-mailing us at foofers@textwise.com.

You must be 13 years and older to register to use the Foof website. If we learn that Foof has collected information from a child under the age of 13, we will delete that information as quickly as possible. We recommend that minors between the ages of 13 and 18 ask and receive their parents' permission before using Foof or sending information about themselves or anyone else over the Internet.

TextWise, LLC may amend this Privacy Policy from time to time, at its sole discretion. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used.
